#MeToo growing

Many women have come up in the past several weeks to describe the examples of sexual harassment and sexual assault:
 While many tweets with #MeToo, women have also talked about past and recent examples of sexual harassment.

Lawyer Ratuja Shinde tells the legal options of women, even if the case is old:

What do you do if you are sexually assaulting?

Under the Sexual Harassment Act, 2013, every organization has to establish an Internal Complaints Committee (ICC) in each office or branch with 10 or more employees. It tells the procedures and defines different aspects of sexual harassment. A victim may suffer a woman "employed or not", who is "accused of being subjected to any act of sexual harassment". It includes the rights of all women who work in any capacity or go to any workplace. (More on that)

How do you say what sexual harassment is?

Any sexual comments, unwanted touches, gestures or sounds made in a woman constitute sexual harassment.

If you were troubled in the previous workplace and neither you nor the persecution do more work on that place then what do you do?

Three months after the harassment incident, a criminal complaint can be lodged against the problem. In cases where it is within three months of harassment work, the victim can file a complaint with the internal grievance committee of the relevant organization.

If you do not have proof of any available incident, does it mean that you can not file a case?

You can still file a case. If a criminal complaint is filed then the investigation authority will look into submitting evidence. Otherwise, it would be difficult to prove it in court due to lack of evidence.

How do you deal with someone after you have filed a complaint on whom you have accused of harassment?

If the harassment continues even after lodging the complaint, then immediately bring it to the notice of the officers and make them confidential for this.

What do you do if you were sexually assaulting? What should not you do?

If you have been sexually harassed, contact the authority who can file a complaint and provide further protection from harassment or threat. Get legal advice on what solutions are available to you. If you are in danger for your life or property, then you may face your harassment alone.
